1. Acceptance of terms

By creating an account, uploading an image, or making a purchase on RadEnhance ("the Service," "we," "us"), you agree to be bound by these Terms & Conditions. If you do not agree, do not use the Service.

2. Eligibility

The Service is intended for use by dental and medical professionals, or individuals acting on their behalf, for professional purposes. You must be at least 18 years old and capable of entering into a binding agreement to use the Service. By using the Service, you represent that you meet these requirements.

3. Description of service

RadEnhance provides automated image-enhancement processing for intraoral periapical (IOPA) X-ray images uploaded by users. The Service is an image-enhancement tool only. It does not provide medical or dental diagnosis, interpretation, or treatment advice. See our Disclaimer for further detail.

3a. Beta programme

RadEnhance is in beta. During the beta, registration may at times be limited to people with a valid invite link, and you confirm you have read the beta notice when registering. Invite links may have a sign-up limit and an expiry date, and please don't forward yours without the inviter's agreement.
The beta is provided for evaluation. Features, plans, prices, and these terms may change, and the Service may occasionally be unavailable or behave unexpectedly. All other sections of these terms, including the disclaimer of warranties and limitation of liability, apply in full.
We welcome feedback on the Service and may use your written feedback to improve it. This does not extend to your uploaded images, which are handled only as described in our Privacy Policy.
Beta coupons (for example, a 100% discount) are subject to Section 9. A plan activated with a 100% coupon involves no charge, so no tax invoice is issued for it, and it counts as $0 spend for image storage tiers.

3b. Free trial

You may process one image per day without an account. The trial is for dental and medical professionals; by using it you confirm that you are one, that you have the right to upload the image, and that you have read the Disclaimer.
Trial images are deleted within one hour; download your result if you want to keep it. These Terms (including the disclaimers and limitation of liability) apply to the trial as to the rest of the Service. We may change, limit, or end the free trial at any time.

4. Account registration and security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
You agree to provide accurate registration information, including a valid email address, which is used for account verification, account recovery (username reminder and password reset), and account-deletion confirmation. Processed results are delivered as in-app downloads, not by email.
You must notify us promptly of any unauthorized use of your account.
We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.

5. Uploaded content and license

You retain ownership of any images you upload ("User Content").
By uploading, you grant us a limited, non-exclusive license to process and store your User Content to provide the Service, and to retain flagged images for quality assurance and regulatory review, as described in our Privacy Policy. We do not use your User Content to train machine learning models.
You represent that you have the right to upload the images you submit, including any necessary patient consent or authorization required under applicable law or professional regulations, and that uploading does not violate any third party's rights or any applicable patient-confidentiality obligation.
We do not sell or share your User Content with third parties for their own commercial purposes, except as described in our Privacy Policy (e.g. infrastructure, storage, payment, and account-email vendors necessary to operate the Service).

6. Acceptable use

You agree not to:

Upload content that is unlawful, infringing, or that you do not have the right to upload.
Attempt to access another user's account, data, or uploaded images.
Interfere with, disrupt, or attempt to circumvent the Service's security, credit system, or rate limits.
Use the Service for any purpose other than its intended use of enhancing your own dental/medical X-ray images.
Reverse engineer, scrape, or attempt to extract the Service's underlying models or processing methods.

We reserve the right to suspend or terminate access for any account found to violate this section.

7. Credits and plans

The Service operates on a credit system. One credit is consumed per processed upload.
Free and paid credits are subject to the daily/period limits, validity periods, and consumption rules described on our Plans page, which forms part of these Terms.
Credits have no cash value, are non-transferable, and cannot be exchanged, sold, or redeemed for cash.
Unused credits expire according to the validity period of the applicable plan and do not roll over or carry forward beyond that period, except as explicitly stated on the Plans page.
Each purchase is a separate plan that starts on its own purchase date. Purchases do not queue or extend one another; they run side by side, and while they overlap their daily credits add up (for example, three Small plans bought on the same day give three times the daily credits and all end on the same date). Credits from the plan ending soonest are used first.
Prices are in Indian rupees (INR) for customers billed in India and in US dollars (USD) for customers billed elsewhere, as shown on the Plans page, and include applicable GST. The currency is determined by the billing country in your profile.
We reserve the right to modify credit allocations, pricing, or plan terms for future purchases, with reasonable notice provided on the Plans page. Changes will not affect credits already purchased and active at the time of the change.

7a. Image storage

Processed images are stored for a period determined by your storage tier at the time of each upload, based on your average daily spend over the last 30 days, as follows:

Average daily spend = total paid today and in the previous 30 days (India time) ÷ 30 — so a monthly subscription counts for its whole month. Your tier is checked at the moment of each upload and locked onto that image: spending more later doesn't extend images already stored, and a plan ending doesn't shorten them.

Stored images can be viewed and downloaded from My Images until their stored-until date, after which they are permanently deleted and cannot be recovered. It is your responsibility to download and keep any image you need for your own records (including clinical record-keeping) before it expires. RadEnhance is not a records-archiving service.
Storage is a feature of your purchases, not a separately purchased service. Storage periods of images already stored are not extended by later purchases, and no refund or compensation is due for deleted images. We may change storage tiers for future uploads with notice on the Plans page.

8. Payments

Paid plan purchases are processed through Razorpay, a third-party payment gateway. We do not store your full payment card or bank account details.
All prices are inclusive of applicable Indian taxes (including GST), where applicable.
Any bank charges, currency conversion fees, or other charges levied by your bank or card provider are payable by you.
Where our payment gateway (Razorpay) applies a convenience fee, it is shown at checkout before you pay, is payable by you, is not part of the plan price, and is not refundable, except where a refund is due to an error on our side (see our Refund & Cancellation Policy).
Plans are non-refundable once activated, including for unused credits, dissatisfaction with results, or accidental purchases, except as set out in our Refund & Cancellation Policy (for example, duplicate charges, or a payment taken without the plan being activated).
You are responsible for verifying plan details before completing a purchase.
Invoices are not emailed. Each invoice can be downloaded as a PDF from Account → Billing history.

9. Coupons and discounts

Coupon codes and location-based discounts are offered at our discretion and may be modified or discontinued at any time.
If more than one discount is eligible on a purchase, only the larger discount is applied -- discounts are not combined.
Coupons have no cash value and cannot be transferred, sold, or redeemed for cash.
We reserve the right to revoke a discount, or take other account action, if we determine it was obtained through misuse (e.g. falsified location data).

10. Intellectual property

The Service, including its software, design, branding, and underlying processing technology, is owned by us and protected by applicable intellectual property laws. Nothing in these Terms grants you any right to our intellectual property except the limited right to use the Service as intended.

11. Disclaimer of warranties

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that processed images will meet your expectations. See our Disclaimer for important information about the non-diagnostic nature of the Service.

12. Limitation of liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from or related to your use of the Service. Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the three (3) months preceding the claim.

13. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, your User Content, or your violation of these Terms.

14. Suspension and termination

We may suspend or terminate your access to the Service at our discretion, including for violation of these Terms, without liability to you. You may stop using the Service and close your account at any time from your Account page, or by contacting us at dzealai@gmail.com. Termination does not entitle you to any refund of unused credits.

14a. Discontinuation of the Service

If we decide to discontinue RadEnhance, we will notify you by email and on the site at least 30 days in advance, stop new purchases and new registrations from the date of the notice, and keep the Service running until every plan purchased before the notice has ended. During this period you can use your credits and download your images and data as usual.
Notice of discontinuation is not, by itself, grounds for a refund.
If the Service has to end before a plan you paid for ends (for example, because of a legal requirement or circumstances beyond our control), we will refund the unused part of that plan pro rata, for each paid day after the Service's final day of operation, to the original payment method. Plans activated with a 100% coupon have nothing to refund.
After the Service ends, your data is handled as described in our Privacy Policy.

15. Changes to these terms

We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

16. Governing law and jurisdiction

These Terms are governed by the laws of India. Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in Mumbai, India.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

18. Entire agreement

These Terms, together with our Privacy Policy and Disclaimer, constitute the entire agreement between you and us regarding the Service.
